This Court on 15.06.2022 disposed of Crl.P.No.4722 of 2022 and the operative portion of the said order reads as follows;

"Learned Counsel for petitioner/A3 submits that he intends to move the trial Court under Section 167 of the Cr.P.C.

In the said circumstances, in the even of this petitioner/A3 filing any application under Section 167 of the Cr.P.C., the concerned Court is directed to dispose of the same on the same day."

Learned Counsel for petitioner submits that he did not express any intention on that day to move the trial Court under Section 167 of cr.p.c but this Court on 15.06.2022 disposed off Crl.P. observing that he intends to move the trial Court under Section 167 of Cr.P.C. and disposed of the same on the said ground. He further submits that it is only 120 days since the detention of the petitioner and he intends to move an application for bail even before completion of 180 days.

OFFIC NOTE In the said circumstances, the petitioner can move fresh application under Section 439 of Cr.P.C. before the expiry of 180 days. Accordingly, this application is ordered.

Accordingly, the earlier order dt.15.06.2022 stands modified with the above observation.
