THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SMT. JUSTI CE ANI S APPEAL SUI T No.658 of 2002 JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) This appeal under Section 54 of the Land Acquisition Act, 1894, is preferred by the claimant dissatisfied with the enhancement of the compensation by the Reference Court of the learned Subordinate Judge, Atmakur, in O.P.No.4143 of 1987.

Sri V. Manohar Rao, learned counsel for the appellant, and the learned Government Pleader for Appeals (A.P.) appearing for the State stated before this Court that the matter is squarely covered by the judgment of this Court in A.S.No.638 of 2002 and batch. A copy of the said common judgment dated 26.07.2013 rendered in A.S.Nos.638, 663, 665 and 828 of 2002 is placed on record.

For reasons alike as were mentioned in the aforestated common judgment and in terms thereof, this appeal is allowed in part enhancing the compensation for the subject land from Rs.12,000/- per acre to Rs.32,400/- per acre. The appellant/claimant would be entitled to statutory benefits, including the interest on solatium and additional market value, in terms of the law laid down by the Supreme Court in Sunder v. Union of I ndia1 and Nagpur I mprovement Trust v. Vasantrao2. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order.
