HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9738 OF 2015 O R D E R :

This petition is filed for a writ of Mandamus directing the respondents to allow the petitioner to participate in the tender, basing on the Circular Memo No.1276/J2/2013, dated 28.12.2013, issued by the 2nd respondent as clearly stated in the said circular for separate tenders may be called from the suppliers for each Revenue Division to minimize the cost of transportation, and for a consequential direction to the respondents to allow the petitioner to participate in the tender process.

The case of the petitioner is that as per Circular Memo No.1276/J2/2013, dated 28.12.2013, separate tenders may be called from the suppliers for each Revenue division to minimize the cost of transportation. But as per the tender notification of the respondents, bidder can submit bids for the entire district or for one or more projects for supply of eggs to AWC's, which is in violation of the above Circular Memo dated 28.12.2013. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner who reiterated the averments in the writ affidavit.

On the other hand learned Government Pleader for Women Development and Child Welfare produced written instructions stating that as per the terms and conditions of the tender notification, the bidder can submit bids for entire district or for one or more projects for supply of eggs to AWC's; that as per averments of the petitioner he himself applied for separate revenue division; that opening of tenders was postponed due to the Chairman of DPC, Ongole, was on leave; and that petitioner was neither prevented nor rejected by the

respondents from making his bid for separate revenue division. Since the 4th respondent in the written instructions stated that even bids for separate revenue division will also be considered, the apprehension of the petitioner that his bid will not be considered is misconceived. In view of the above, it is open for the respondent authorities to process and finalise the tender process in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions if any pending in the writ petition shall stand closed.
