HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.14330 OF 2015 ORDER:

Petitioners claim to be the owners of the house plots in Sy.No.766/1, Hanumakonda Revenue Village and Mandal within the Greater Warangal Municipal Corporation. Petitioners claim to have constructed compound walls around the house plots. Later, they applied for grant of building permission to construct buildings in those plots. While their applications for building permission are pending, the respondent-corporation issued notice dated 07.03.2015 and thereafter further notice dated 18.03.2015 under Section 452(2) of Greater Hyderabad Municipal Corporation Act, 1955. On the said notice, petitioners filed explanations dated 18.04.2015. The matter is pending for consideration before the respondent-corporation at this stage.

2. Learned standing counsel, on instructions, submits that the corporation is willing to dispose of the issue considering the applications submitted by the petitioners and the writ petition may be disposed of accordingly.

3. Learned counsel for the petitioners agrees for disposal of the writ petition with a direction to the respondent corporation to consider the explanations submitted by the petitioners and to pass appropriate orders.

4. Having regard to the said submissions, writ petition is disposed of directing the respondent corporation to consider the explanations submitted by the petitioners pursuant to the notice dated 18.03.2015 and pass appropriate orders as warranted by law within a period of four weeks from the date of receipt of a copy of this order. Till then status quo granted on 07.05.2015 shall be maintained.
