D. Tirupathi, v. The Northern Power Distribution Company Limited
HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.21474 of 2012 Order:
Heard Sri Dasari Vijaya Kumar, learned counsel appearing for the petitioner and Sri P.Lakshma Reddy, learned Standing Counsel for APNPDCL-respondents 1 to 3.
2. It is submitted that the petitioners are contract labours in the respondents-Company. The petitioners sought regularisation of their services as per B.P.Ms.No.36, dated 18-5-1997. Their certificates were verified and their cases for regularisation were rejected on the ground that the certificates were not genuine as per the Vigilance Report. The rejection proceedings were passed in the year 2012. Questioning the rejection proceedings, the petitioners filed W.P.No.21474 of 2012. While the writ petition was pending, the respondents withdrew the proceedings on 29-11-2014. After withdrawal of the said proceedings, it is submitted that the petitioners submitted a representation dated 05-12-2014 along with all the certificates and other documents and the same is pending consideration with the respondents. Since the proceedings dated 04-5-2012 were withdrawn on 29-11-2014 by the respondents, the validity of the said proceedings need not be examined in the present writ petition.
3. Under the above circumstances, the writ petition is disposed of directing the respondents to consider the certificates and other documents submitted by the petitioners on 05-12-2014 and pass appropriate orders regarding the regularisation of their services in accordance with the Rules. The petitioners are at liberty to file any other documents before the respondents which are relevant for consideration of the regularisation of their services.
The respondents are directed to consider the cases of the petitioners in the light of the documents submitted by them and pass appropriate orders within a period of 8 (eight) weeks from the date of receipt of a copy of this order.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
