THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1435 of 2014 ORDER:
This Criminal Petition is filed by A.4 under Section 482 Cr.P.C., to quash the proceedings in C.C.No.250 of 2010 pending on the file of Judicial First Class Magistrate, Vemulawada, registered for the offences under Sections 452, 323, 417, 201 of IPC.
Heard.
It is submitted by the learned counsel for the petitioner that in C.C.No.314 of 2008, which was also arising out of same crime, A.2,A.3,A.5,A.7 to A.10, A.12 to A.14 were tried and acquitted by Judicial First Class Magistrate, Vemulawada by judgment dated 5.6.2012. Further as against A.1, the proceedings were quashed by this Court in Crl.P.No.1435 of 2005 by order dated 15.9.2006.
Considering the fact that the petitioner herein is also similarly situated with that of other accused who were tried and acquitted by the trial Court, the impugned proceedings as against the petitioner herein are liable to be quashed.
In the result, the Criminal Petition is allowed and the proceedings in C.C.No.250 of 2010 pending on the file of Judicial First Class Magistrate, Vemulawada are herein quashed as against the petitioner herein. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
