HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4731 OF 2017 ORDER:
The case of the petitioner is that he made a representation on 08.03.2016 before the 4th respondent seeking to initiate prosecution under Section 82 and 83 of Registration Act, 1908 against 6th respondent and others for fraudulently executing the registered gift deed dated 12.08.2009 vide document No.4896/2009 by way of impersonation without having title, besides suppressing the material facts and for cancellation of the gift deed executed by the 6th respondent in favour of the 7th respondent. As no action has been initiated, the present writ petition is filed. Learned counsel for the petitioner admits that the said relief cannot be granted in the writ petition. Heard the learned Assistant Government Pleader for Revenue.
In view of the above, the writ petition is disposed of directing the respondents 3 and 4 to take action under Section 82 and 83 of the Act, within a period of three (03) months from the date of receipt of copy of this order but not for cancellation of the registered gift deed as sought for in the representation filed by the petitioner on 08.03.2016.
However, it is for the petitioner to avail alternate remedy available under law against the cancellation of registered gift deed, before the competent Court. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 10.02.2017 dv
