Heard Mr.Resu Mahender Reddy for petitioner, the Government Pleader for Panchayat Raj for Respondents Nos.1 to 3, and Mr.K.Ramachandra Reddy, representing Mr.G.Narender Reddy, for Respondent No.4.

Petitioner challenges show cause notice dated 01.08.2012 on various factual grounds. One of the objections raised is that the notice impugned in the writ petition is at the instance of 3rd Respondent, in retort to a complaint made against the Sarpanch of 4th Respondent and therefore the petitioner prays for setting aside the notice.

Except the above ground no other ground is urged before this Court. After perusing the counter-affidavit, I am satisfied that the contention is coined for the purpose of invoking the jurisdiction of this Court under Art.226 of the Constitution of India. The petitioner challenges the notice issued by the 4th Respondent and no ground warranting interference against a notice simplicitor has been made out. The petitioner at best can be given time to submit explanation within four weeks from today, and the 4th Respondent can be directed to pass orders after considering the reply submitted by the petitioner. Since the petitioner apprehends
demolition in the meantime, to preserve status quo as on date, the Respondents are directed not to demolish the structures at the subject matter of the writ petition for a period of three months, and likewise the petitioner shall not also undertake further constructions in the meantime. The 4th Respondent is directed to pass orders within four weeks from the date of receipt of reply from the petitioner.

The writ petition is disposed of as indicated above. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
