HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7428 of 2024 ORDER :

Petitioner/accused No.2 has filed this petition under Section 438 of Cr.P.C. seeking anticipatory bail in Cr.No.233 of 2024 of P.S. Suryapet II Town, registered for the offences under Sections 120B, 406, 420, 468, 470 and 471 of IPC.

Heard Sri M.Venkat Ram Reddy, learned counsel for petitioner/accused No.2 and the learned Additional Public Prosecutor appearing for the respondent-State.

Case of the prosecution is that accused Nos.1 and 3, who are employees of Corporate Client Group have sanctioned personal loans to the customers without their consent by manipulating the documents and also sanctioned second loan to the existing borrowers and transferred the said amounts into the personal accounts of the petitioner herein/accused No.2 and other accused, due to which, the bank was defrauded to a tune of Rs.5,32,21,678/-. 4.

Learned counsel for petitioner/accused No.2 submits that the petitioner herein is innocent and no specific role is attributed to the petitioner/accused No.2. He further submits that the petitioner herein

JS, J Crl.P.No.7428 of 2024 is not an employee of the Bank and merely as the petitioner is the wife of accused No.1, she was implicated in the case, and hence, prayed to allow the petition.

The learned Additional Public Prosecutor opposed the bail application contending that the investigation is in progress and they have to examine some more witnesses. It is further contended that if the petitioner is released on bail, she may tamper with the evidence, which would cause prejudice to the investigating agency, and hence, prayed to dismiss the petition.

On perusal of the complaint and remand case diary, it is apparent that no specific allegations are levelled against the petitioner/accused No.2 regarding her involvement in the crime and since accused No.1, who is the husband of petitioner/accused No.2 is in judicial custody, this Court is of the considered view that the petitioner/accused No.2 can be granted anticipatory bail subject to the following conditions:

i.

The petitioner/accused No.2 shall surrender before the Station House Officer, P.S. Suryapet II Town, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner/accused No.2 on bail

JS, J Crl.P.No.7428 of 2024 on executing a personal bond for Rs.20,000/- with two sureties, for the like sum each.

ii.

The petitioner/accused No.2 shall appear before the SHO concerned on every Sunday between 10.00 a.m. and 5.00 p.m., for a period of eight (8) weeks or till filing of charge sheet, whichever is earlier.

iii.

The petitioner/accused No.2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. Petition is accordingly allowed.
