HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 9392 of 2017 Order:

This Writ Petition is filed challenging the registration of Crime No.4 of 2017 on the file of Doravari Satram Police Station, Sri Potti Sri Ramulu Nellore District.

The said crime was registered pursuant to a complaint lodged by the third respondent with regard to missing of her daughter. The daughter was later on traced and the statement of the daughter was recorded. On recording the statement of the daughter, the section of offence was altered and the investigation is being conducted under the provisions of the Protection of Children from Sexual Offences Act, 2012 read with Sections 366 and 376 of IPC.

Learned counsel for the petitioners submits that the petitioners are being harassed pursuant to the investigation that is being conducted by the second respondent.

In the circumstances, it is needless to observe that the second respondent who was investigating Crime No.4 of 2017 shall follow due process of law including a notice under Section 41-A of the Code of Criminal Procedure.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
