No representation for petitioner. Heard the Assistant Government Pleader (Home) for respondents.
The petitioner complains against respondents 2 and 3 in interfering in matrimonial dispute between the petitioner and his wife as illegal and without jurisdiction. The petitioner prays for a consequential direction to respondents not to harass the petitioner.
The 3rd respondent has filed counter affidavit and has substantially denied the allegations of unauthorized and illegal interference in matrimonial dispute by police. The 3rd respondent refers to Cr.No.7 of 2013 registered for the offences under Section 498-A IPC and Sec tion 4 of Dowry Prohibition Act and states that the petitioner is one of the accused. According to 3rd respondent, all the accused are absconding. He denies the allegations of harassment and interference in matrimonial dispute but submits that as the petitioner is one of the accused, the investigation is pursued within the four corners of law. He prays for dismissing the writ petition.
From the stand taken in the counter affidavit, it is evident that firstly a crime is pending investigation against petitioner and
secondly the 3rd respondent by way of reply has stated that except registering the crime in accordance with law, the petitioner was not harassed.
This Court is of the view that by placing the above statement on record, the writ petition c an be disposed of. The writ petition is disposed of accordingly. No order as to costs.
