HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 5637 of 2017 Order:

This Writ Petition was filed seeking a direction to the respondents 1 to 4 to provide police protection from the unlawful interference of the respondents 5 to 7 in respect of the petitioners property situated in Survey No.676, admeasuring Ac.14.38 gts., of Chengal village, Bheemgal Mandal, Nizamabad district.

The petitioners state that they filed O.S.No.3 of 2017 before the Junior Civil Judge Court, Armoor seeking perpetual injunction against the respondents 5 to 7 and also sought temporary injunction in I.A.No.7 of 2017. In I.A.No.7 of 2017 temporary injunction was granted on 25.01.2017. In spite of the temporary injunction, when the respondents 5 to 7 tried to interfere, they lodged complaints and those complaints were registered as Crime No.19 of 2017 on 27.01.2017 and Crime No.29 of 2017 on 11.02.2017.

Now, the learned counsel for the petitioners submits that even after registration of the complaints no further action is being taken by the police and taking advantage of the same the respondents 5 to 7 are trying to interfere with the property of the petitioners and, hence, they should be provided police protection.

There cannot be a direction to continuously provide police protection to the lands of the petitioners and, if the petitioners approach the fourth respondent for protection on a specific date, the fourth respondent shall provide the same. It is needless to observe that the fourth respondent shall continue the investigation pursuant to the registration of the above crimes.

The Writ Petition is, accordingly, disposed of giving liberty to the petitioners to approach the fourth respondent with a representation to provide police protection on a particular day specifically intimating the date on which the police protection is needed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
