HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5175 of 2018 ORDER :
This criminal petition filed under Section 438 Cr.P.C. by the petitioner/A.1 in Crime No.323 of 2017 of Vanasthalipuram Police Station, Rachakonda, registered for the offences punishable under Sections 420, 468 and 471 IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, and perused the F.I.R. and the bail application averments.

From the very report, the signatures of the de facto complainants, by name Sri N.R.G.
Narayana Reddy and Smt.G. Bharathi, were forged, they are suspecting the same by the petitioner. The petitioner is president of Hariharapuram Welfare Association, undisputedly. The stamp on which the so-called forged signatures contain purchased by him in his name. Though, it is his contention of the signatures are genuine and he did not forged and he is falsely implicated, if not Section 468 IPC, Section 471 IPC applies in using as genuine forged signatures document. Thereby, there is prima facie accusation. Leave about Section 428 IPC applicable or not and it is premature to observe anything when the investigation is at nasal stage.

Having regard to the above, there are no grounds to grant anticipatory bail, but for rather than dismissal, the criminal petition is
disposed of, giving liberty to surrender and move for regular bail before the learned Magistrate concerned to consider for granting of the regular bail, if not on the same day atleast by next day, after hearing the learned Public Prosecutor, with necessary conditions of securing the presence, assurance of availability during investigation to appear before the police for purposes of investigation, deposit of passport and furnish bank account, if any, etc., Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B.
