ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused in Crime No.244 of 2026 before the Tolichowki Police Station, Hyderabad, registered for the offences punishable under Sections 69 of BNS. 2.

The brief facts of the case are that the de facto complainant alleged that she became acquainted with the petitioner through the Dating App "Bumble" in June, 2025. It is alleged that on the promise of love and marriage, the petitioner established a physical relationship

with her between July, 2025 and October, 2025. Subsequently, the de facto complainant came to know that the petitioner was already married and that he emotionally manipulated her and later blocked all communication with her.

Heard Dr. Challa Srinivasa Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the present crime with an ulterior motive to harass and blackmail him and extract money from him and that both the petitioner and the de facto complainant are majors and the relationship between them was purely consensual in nature. He further submitted that similar complaints were earlier made before Tolichowki Police Station and Jeedimetla Police Station, but no case was registered after enquiry. It is also submitted that the petitioner himself lodged complaints against the de facto complainant for threats, blackmail and monetary demands. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Assistant Public Prosecutor opposed the grant of anticipatory bail contending that there are serious allegations against the petitioner that he induced the de facto complainant into physical relationship on the false promise of marriage while concealing his marital status and that the investigation is at a crucial stage and electronic evidence including chats and phone records are required to be examined thoroughly. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the allegations arise out of a personal relationship between the petitioner and the de facto complainant and the matter requires thorough investigation. Further, prima facie, the relationship between the petitioner and the de facto complainant appears to be consensual in nature. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Tolichowki Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.50,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any, pending in this petition, shall stand closed.
