THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5230 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioners/A2 and A3, seeking to grant anticipatory bail in Crime No.71 of 2019 on the file of Medipalli Police Station, Jagtial District, registered for the offences under Sections 420, 506 read with Section 34 IPC. 2.

Heard learned counsel for the petitioners/A2 and A3, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the remand case diary of A1 that all the accused promised the de-facto complainant to provide jobs in High Court within three months and on believing their deceitful words, he gave an amount of Rs.5 lakhs on 22.05.2013 and Rs.9 lakhs on 07.02.2015, and they also executed promissory notes for the said amount. After completion of the said period, the accused postponed the same and when the de-facto complainant asked about his money, they threatened him with dire consequences. 4.

Learned counsel for the petitioners/A2 and A3 submits that the petitioners are innocent of the alleged offences and falsely implicated in the present case. He further submits that as the material part of the investigation is completed by examining all the material witnesses, there is no question of tampering with the prosecution witnesses. He further submits that the petitioners are permanent residents of their villages and they are ready to furnish sufficient sureties before the Court.

There are specific allegations against the petitioners that they received amounts from the de-facto complainant for providing job in High Court, but no such job was provided. In view of the nature of allegations leveled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners and their prayer for anticipatory bail is refused. However, if the petitoners/A2 and A3 surrender before the trial Court within 10 days from today and move an application for bail, the trial Court shall consider the same in accordance with law on the same day.

With the above directions, the Criminal Petition is disposed of. 7.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
