In view of the order passed in CMA No.56 of 2011, objections raised by the insurance company in this appeal are not tenable. As the objection raised in this appeal is the same in CMA No.56 of 2011, which is negatived today nothing survives in the appeal. Hence, this C.M.A. is dismissed.

No costs.
