The case of the petitioners is that petitioners were assigned land in Survey Nos.605-3, 582-1 and 583-3, admeasuring Ac.1.05 cents, Ac.0.75 cents and Ac.0.35 cents, situated at Dampuru Village, Vidavaluru Mandal, SPSR Nellore District and their names were also reflected in the revenue records in the possession column. While so, respondents 3 and 4 came to petitioners' lands on 27.07.2017 and made some markings. When petitioners questioned the same they have informed that they are proposing to lay the road through petitioners' lands. Aggrieved by the action of the respondents in laying road without following due process of law, present writ petition is filed.

Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Panchayat Raj, produced written instructions stating that subject land is a Government land and petitioners are not in possession of the said land.

Prima facie, in the Adangals and Pahanies filed by the petitioners, in respect of Survey No.605-3, to an extent of 1.05 cents, 1st petitioner's name is shown in the possessor's column and CJFS is shown in the pattedar column; in respect

of Survey No.582-1 to an extent of 0.75 cents, petitioner's name is shown in the pattedar column as well as possessor's column; and in respect of Survey No.583-3 to an extent of 0.35 cents, 2nd petitioner's name is shown as lessee in possessor's column under CJFS scheme.

In view of the aforesaid facts and circumstances, since petitioners' names were recorded in the Adangals and Phanies, the writ petition is disposed of directing the respondent authorities to follow due process of law before evicting the petitioners. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.12.2017 t k.
