HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7480 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in rejecting the claim of the petitioner for absorption as Electrician vide proceedings dated 30.01.2001, as illegal and arbitrary.

Learned counsel for the petitioner has contended that the petitioner is entitled for absorption in terms of B.P.Ms.Nos.36 and 37 dated 18.05.1997.

On the other hand, learned standing counsel for the respondents has contended that B.P.Ms.No.37 was withdrawn during 2003 and B.P.Ms.No.36 was withdrawn during 2006 and, hence, the case of the petitioner cannot be considered at this point of time. Having considered the submissions made by the learned counsel on either side and in the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents. Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon within four weeks thereafter.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 16th November, 2018 cbs
