Petitioner challenges the memo dated 26.02.2019 whereunder the 4th respondent Tahsildar, Nellikuduru Mandal reduced the extent of land of the petitioner from Ac.0.25 guntas to Ac.0.05 guntas in Survey No. 163/1 situated at Madanathurthi Village, Nellikuduru Mandal of Mahabubabad District in the revenue records.
Heard learned counsel for the petitioner as well as learned Government Pleader for Revenue.
The sum and substance of the memo is to the effect that the petitioner was assigned land to an extent of Ac.0.05 guntas, whereas she obtained the entries in the revenue records to the extent of Ac.0.25 guntas which, in fact, is the government land in Khata No. 211 in Survey No. 163/1. In those circumstances, by the impugned memo, the petitioner was intimated that necessary steps would be taken to alter the entries in the revenue records. It is the specific contention of the learned counsel for the petitioner that without issuing notice nor conducting any enquiry, the 4th respondent cannot alter the entries made in favour of the petitioner which were in existence since 2014 and even before. From the impugned memo dated 26.02.2019, it is not clear whether notice was issued to the petitioner prior thereto. Therefore, considering the specific apprehension of the petitioner and also considering the fact that there is no reference of earlier proceedings in the impugned memo, making it clear that the same shall be treated only as a notice, the Writ Petition is
disposed of with a direction to the respondent authorities not to interfere with or alter the entries in the revenue records without putting the petitioner on notice and calling for her explanation and without considering the same in accordance with law.
