HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.38911 of 2014 ORDER:
This writ petition is filed to declare the action of the respondents in not taking any action against the unauthorized occupation of public road by the 4th respondent in Sy.Nos.132, 133, 137 of Serilingampally Mandal, Ranga Reddy District, as illegal and arbitrary. According to the petitioner, there is 30 feet public road abutting his house and the same has been encroached by the unofficial Respondent No.4.
Respondents 2 and 3 /Greater Hyderabad Municipal Corporation filed counter affidavit stating that there is no existing road as alleged by the petitioner; it is for the petitioner to submit necessary documents to prove that there is road and not private property and if the petitioner submits necessary documents, the officials will take necessary steps to remove the encroachment of the road, if any. It is further submitted in the counter affidavit that the said land in question is not part of any approved layout and hence, the officials could not come to a conclusion with regard to the title of the property, whether it is private property or public property.
Heard the learned counsel for the petitioner and the learned Standing Counsel for the Municipal Corporation. In view of the rival contentions, the petitioner is at liberty to file a detailed representation setting forth his grievance to the 3rd respondent within a period of two weeks from the date of receipt of a copy of this order and on filing such representation, the 3rd respondent shall consider the same and pass appropriate orders, in accordance with law, after giving reasonable opportunity of hearing to the petitioner and respondent no.4, within a period of eight weeks therefrom. With the above directions, the Writ Petition is disposed of. No order as to costs.
