THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18917 of 2016 ORDER:

The petitioner claims to be the owner of properties in D.Nos.2-26, 2-27, 2-35 and 2-24 in Penumaka Village, Tadepalli Mandal, Guntur District, and is paying house tax. She states that respondent Nos.3 and 4 visited the subject properties and asked to vacate as they require the same for road widening purpose. The grievance of the petitioner is that, though she is in possession of the subject properties, the respondents are trying to demolish the same without following due process of law.

Heard the learned counsel for the petitioner. On instructions, learned Assistant Government Pleader for Revenue submits that the respondents would follow due process of law in case the properties are required for road widening or any other purpose.

Recording the submission of the learned Assistant Government Pleader for Revenue, the Writ Petition is disposed of directing the respondents not to dispossess or demolish the structures belonging to the petitioner without following due process of law and, thereafter, proceed in accordance with law.
