THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.14153 OF 2015 ORDER:
This Writ Petition is filed for a Writ of Mandamus declaring the action of the second respondent in interfering with the management of the petitioner in respect of Syed Moinduddin Sha Qhadri @ Gooril Thata Dargah situated at S.Kondapuram Village, Baichigeri Gram Panchayat, at the instance of the fifth respondent, as illegal and arbitrary.
The case of the petitioner is that the petitioner purchased the land in which Dargah is located in Survey No.26 to an extent of 12 1⁄4 cents through registered sale deed dated 15.04.2015 for Rs.4,04,000/- and got fenced the said land. While so, the fifth respondent, who has nothing to do with the Dargah, started interfering with the management of the petitioner and approaching the authorities seeking appointment of Muthavali of Dargah. The petitioner made several representations in this regard including the one dated 02.05.2015.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.
Basing on the written instructions dated 06.05.2015, learned Assistant Government Pleader submitted that the Station House Officer, Adoni Taluq Police Station, Kurnool District, received representation from the fifth respondent with regard to the management of the Dargah and suggested the fifth respondent to approach the Court for redressal of his grievance. It is denied that at the instance of the fifth respondent, the second respondent-Station House Officer interfered with the management of the petitioner. Further it is stated that the second respondent is maintaining law and order to keep peace and tranquility in the jurisdiction. It is further stated that they enquired into the representation made by the petitioner and forwarded the same to the Superintendent of Police, Kurnool District. In view of the above, the Writ Petition is disposed of directing the respondentauthorities to consider and dispose of the representation of the petitioner dated 02.05.2015 in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
