This Criminal Petition is filed for grant of pre-arrest bail to the petitioner, who is arrayed as accused, in Crime No.96 of 2026 of the Police Station Wanaparthy, Wanaparthy District. The offences alleged against the petitioner are punishable under Sections 376(2) (n), 313 of Indian Penal Code, Section 69 of Bharatiya Nyaya Sanhita, 2023 (for short, "BNS") and Section 5(1) read with Section 6 of POCSO Act, 2012.

Learned counsel for the petitioner submits that the complaint was filed on 21.04.2026 in respect of the incident which had happened in the year 2018 when the victim was a minor. It is further submitted that after the complaint was registered, the petitioner/accused as well as the victim got married and are presently living together as husband and wife. In proof the same, the petitioner has filed photographs which were taken at the time of marriage. Therefore, it is contended that no useful purpose would be served by taking the petitioner into custody. 3.

Learned Assistant Public Prosecutor, on instructions, does not dispute the factum of marriage between the petitioner and the victim. He further submitted that the intimation about the filing of this application has been given to the victim, however, there is no representation on behalf of the victim.

Having regard to the above submissions and in view of the fact that the dispute between the parties is now resolved and they are living together, this Court is of the opinion that the petitioner can be granted anticipatory bail.

Accordingly, the Criminal Petition is allowed. The petitioner/accused shall be enlarged on bail in the event of his arrest in connection with the above crime on the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Wanaparthy Police Station, Wanaparthy District, within two (2) weeks from today and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.25,000/- with two sureties, for the like sum each to the satisfaction of the Police Station Wanaparthy Town, Wanaparthy District.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
