HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27890 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the proceedings No.Pen.II/950/2016, dated 18.03.2017, issued by the 1st respondent in granting only provisional pension i.e., 75% of pension, instead of normal/full pension to the petitioner as well as in not considering the representation submitted by the petitioner dated 30.03.2017 to 2nd respondent, which was forwarded by the 2nd respondent to the 1st respondent with a request to examine the request of the petitioner and take necessary action as per law by issuing Memo No.372/Vig.III(1)/2017-3, dated 29.05.2017, as arbitrary and illegal and for a consequential direction to the respondents to forthwith pay normal/full pension with interest to the petitioner.

Learned counsel for the petitioner submits that the petitioner submitted representation dated 30.03.2017 to the 2nd respondent which is pending before the competent authority and that the writ petition can be disposed of with a direction to the competent authority to dispose of the representation of the petitioner. Heard learned Government Pleader for Services. Since the grievance of the petitioner by way of representation dated 30.03.2017 is pending before the competent authority, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to dispose of the representation of the petitioner dated 30.03.2017, in accordance

with law and take action within a period of four weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
