ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.261 of 2026 before the Jubilee Hills Police Station,

Hyderabad, registered for the offence punishable under Sections 69, 118(1), 351(2) of BNS.

The brief facts of the case are that the petitioner/accused developed acquaintance with the victim from 2003, promised to marry her, and established a physical relationship from 2008. Even after his marriage in 2010, he allegedly continued the relationship by making false promises of divorce, blackmailing the victim with private photos and videos, and subjecting her to repeated sexual, physical, and emotional abuse, including forced abortions. It is further alleged that on 20.04.2026, he assaulted the victim with an iron rod and threatened her.

Heard Sri K. Krishna Shrawan, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the relationship between the petitioner and the victim was consensual and long-standing, and the allegations are false and motivated and that the victim continued the relationship

even after knowing about the petitioner's marriage and later demanded money and second marriage, and upon refusal, lodged the complaint. The allegations of assault and coercion are denied, and it is argued that the ingredients of the alleged offences are not made out. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.

Learned Additional Public Prosecutor opposes the bail application, contending that the allegations disclose serious offences involving repeated sexual exploitation, physical assaults, and criminal intimidation. He submitted that the investigation reveals consistent statements of the victim and supporting witnesses, and there is material indicating coercion and abuse. Therefore, he prayed the Court to dismiss the Criminal Petition.

The victim submitted that the petitioner deceived her from a young age with false promises of marriage, despite already being married, and continued to exploit and abuse her for years. She alleges repeated threats using private photos, forced abortions, and multiple instances of brutal physical assaults, including attempts to strangulate and kill her. She further contends that the petitioner's claims are false, there

are contradictions in his version, and she possesses supporting evidence. Therefore, she prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the dispute arises out of a longstanding relationship between the parties. The main allegation against the petitioner is that he exploited the victim on the false promise of marriage and subjected her to physical and mental abuse. The contention of the victim is that she was deceived, threatened, and assaulted on multiple occasions. However, as seen from the record, the relationship between the parties appears to be consensual and continued over a considerable period since 2003. Considering the prolonged consensual relationship and the incarceration of the petitioner since 24.04.2026, this Court deems it fit to grant bail to the petitioner subject to conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum

each to the satisfaction of the XVII Additional Chief Judicial Magistrate, Nampally, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

iv.

The petitioner shall not directly or indirectly contact, communicate with, meet, approach, or attempt to contact the victim/de facto complainant or any of her family members, relatives, or witnesses in any manner whatsoever, including through phone calls, messages, social media

platforms, electronic communication, or through third parties.

v.

In the event of violation of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail before the competent Court.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
