ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 to 4, in Crime No.93 of 2026 of Ellanthakunta Rural Police Station, Rajanna Sircilla District, registered for the offences punishable under Section 108 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that, on 04.05.2026, the de-facto complainant lodged a report before the police stating that the deceased was married to Accused No.1 in
the year 2011 and they lived together happily for some time. For the past five years, Accused No.1 allegedly subjected the deceased to harassment by suspecting her character and several panchayats were conducted in this regard. It is further stated that on 02.05.2026, Accused No.1 took the deceased from her sister's house to Thallapally Village and continued to harass and assault her. Due to continuous harassment, torture, and insults by Accused Nos.1 to 4, including taunting her for not having children, the deceased consumed poison. She was initially shifted to Government Hospital, Karimnagar and later to MGM Hospital, Warangal, wherein she died on 04.05.2026 while undergoing treatment. Hence, the complainant requested the police to take necessary action. Based on the said complaint, the police registered the above case against the petitioners for the aforementioned offences.

Heard Sri K. Shravan Kumar Patel, learned counsel appearing on behalf of the petitioners as well as Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and have been falsely implicated in the present case. It is further submitted that the alleged complaint does not mention any specific date, time or incident of harassment attributable to the petitioners and that the allegations do not constitute an offence under Section 108 of the BNS. It is further submitted that the custodial investigation of the petitioners is not required. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the petition stating that there are clear allegations against the petitioners and that due to the harassment of this petitioners only, the victim committed suicide. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are arrayed as accused Nos.2 to 4 and that the case arises
out of matrimonial disputes between the deceased and accused No.1 and due to the harassment of the petitioners and the subsequent death of the deceased by consuming poison. As seen from the record, there are allegations against the petitioners and the allegations against the petitioners are that they harassed the deceased, as such, she committed suicide and the report is filed by the mother of the deceased and there are no specific allegations or averments in the complaint that the petitioners abetted the victim to commit suicide. 7.
Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to compliance of the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Ellanthakunta Police Station, Rajanna Sircilla District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each,
with two sureties, for the like sum each.
ii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.
iii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
