ORDER

This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') praying this Court to enlarge the petitioner/ accused No.1 on bail in Crime No.273 of 2026 of Khammam Rural Police Station, Khammam District, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substance Act, 1985 (NDPS Act).

The brief facts of the case are that on 23.04.2026, the accused were found in possession of 6.556 kilograms of ganja. Basing on the same, a criminal case was registered against the accused for the alleged offences.

Heard Mr.J.P.Srikanth, learned counsel for the petitioner and Mr. Jithender Rao Veeramalla, learned Additional Public Prosecutor for the respondent-State and perused the materials on record.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been in judicial custody since 23.04.2026 and that the seized contraband i.e.,6.556 kilograms of dry ganja, constitutes an intermediate quantity and that the material part of investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that although the seized contraband falls under the category of intermediate quantity, the investigation is still ongoing. Therefore, granting bail to the petitioner, at this

stage, does not arise. Hence, prayed the Court to dismiss the Criminal Petition.

Considering the submissions made by both learned counsel and upon perusal of the material available on record, it is observed that the seized contraband, i.e., 6.556 kilograms of dry ganja, falls under the category of intermediate quantity and the petitioner has been in judicial custody since 23.04.2026, and a substantial portion of the investigation has already been completed.

Taking into account, the overall facts and circumstances, the quantity of contraband seized and the period of incarceration, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i. The petitioner/A1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class at Khammam.

ii. The petitioner/A1 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner/A1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv.

The petitioner/A1 shall furnish his mobile number and surrender his passport, if any, before the trial Court and shall not leave the Country without prior permission from the trial Court.

v.

The petitioner/A1 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

vi.

The petitioner/A1 shall not hamper the investigation or tamper with the prosecution evidence in any manner.

vii.

The petitioner/A1 shall abide by the conditions stipulated under Section 480(3) of the BNSS.

viii.

In the event of breach of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
