THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.35871 OF 2015 ORDER:
Petitioners claim that they purchased various extents of land in survey Nos.66/3, 66/4 and 2/4 set out in the prayer of this Writ Petition. They also stated that they have been granted pattadar passbooks and title deeds and their names were also mutated in the revenue records. While they are in possession and enjoyment of the said lands, the 3rd respondent is allegedly taking steps to allot the petitioners lands to grave yard without issuing any notice and without following the due process of law. Hence, the present Writ Petition is filed. Learned Government Pleader for Revenue, on instructions, submits that due process of law would be followed while taking steps to resume and allot the petitioners lands, if necessary, for Burial ground for Scheduled Caste people in the Village.
The instructions further show that the lands in question are assigned lands as per R.S.R. It is further stated that no action has been initiated so far to allot the petitioners' lands to the Grave yard, as alleged. In view of the above, without due process of law, the 3rd respondent shall not allot the petitioners' lands to grave yard.
