THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5232 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioners/A4 and A7, seeking to grant anticipatory bail in Crime No.132 of 2019 on the file of Thangallapalli Police Station, Rajanna Siricilla District, registered for the offences under Sections 307, 325 read with Section 149 IPC. 2.

Heard learned counsel for the petitioners/A4 and A7, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that on 15.07.2019, all the accused had assaulted the father of the de-facto complainant and his younger father with an intention to kill them by beating with iron rods and stones resulting severe bleeding injuries. 4.

Learned counsel for the petitioners/A4 and A7 submits that the petitioners are innocents of the alleged offences as they have not committed any offence. He further submits that they were falsely implicated as they acted as elders of A2 and A3 in the land dispute. Learned counsel further submits that A1 to A3 and A5 and A6 were already released on bail and that entire investigation is completed except filing of charge sheet. He further submits that the petitioners have not involved in any criminal cases and they are having sufficient immovable properties and permanent houses at their village and they will abide by the conditions imposed by this Court while granting anticipatory bail.

As seen from the contents of the FIR, there are specific allegations against the present petitioners that they along with the other accused have attacked the father of the de-facto complainant and his younger father with iron rods and stones resulting serious injuries to them. In view of the nature of allegations leveled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners and their prayer for anticipatory bail is refused. However, if the petitoners/A4 and A7 surrender before the trial Court within 10 days from today and move an application for bail, the trial Court shall consider the same in accordance with law on the same day.

With the above directions, the Criminal Petition is disposed of. 7.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
