ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.2 in NCB.F.No.IV/4/31/Crime No.06 of 2026 before the Narcotics Control Bureau, Hyderabad Zone, registered for the

offence punishable under Sections 8(c) read with 20(b)(ii)(C), 28 and 29 of the NDPS Act, 1985.

The brief facts of the case are that on 15.03.2026 upon receiving credible information that the accused persons were illegally transporting contraband, the police conducted a raid and arrested accused No.1. Based on the confession statement of the co-accused, Dhana Laxmi, it was revealed that the petitioner and one Krishna Kumar Raja were actively involved in the transportation and delivery of ganja. Thereafter, acting upon the said information, the NCB team proceeded to Rajahmundry and apprehended the petitioner with a huge commercial quantity of ganja. Hence, the complaint.

Heard Sri Ravi Prasad, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. He further submits that the petitioner is neither the owner of the car nor the owner of the contraband, and that

he has been falsely implicated based on the confession statement of Dhana Laxmi. In support of his submissions, he relied upon the judgment in the cases of Navnath Popat Jadav v. State of Odisha1. In similar circumstances, the Court granted relief. Therefore, he prayed that this Court grant bail to the petitioner by allowing this Criminal Petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the submission made by the learned counsel for the petitioner, stating that the petitioner was arrested based on the confession statement of Dhanlaxmi, who is a co-accused. He further submits that the investigation is still pending and that the petitioner was found in possession of huge commercial quantity of ganja, for which there is no explanation from the petitioner. Hence, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and considering the serious allegations levelled against the petitioner and huge commercial quantity of ganja (169.85 Kgs) was seized from the possession of the petitioner. The petitioner admitted that at the instructions of one Mr. 1 BLAPL No.3344 OF 2026

Krishna Kumar Raja, he had parked the vehicle at the said place, this Court is of the considered view that the investigation is yet to be completed. Therefore, this Court is not inclined to grant bail to the petitioner at this stage. 7.

Accordingly, this Criminal Petition is dismissed. Miscellaneous applications, if any pending, shall stand closed.
