HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.4750 of 2017 ORDER:

The prayer in the writ petition is as under:

" to issue a Writ, order or direction more particularly one in the nature of Writ of mandamus declaring the impugned Lookout Circular issued by respondent No.3 is illegal, arbitrary and violative of the Articles 14 & 21 of the Constitution of India and contrary to the orders of this Hon'ble Court dated 08-11-2016 passed in W.P.No.38267 of 2016 apart from being violative of the principles of natural justice and the same is liable to be set aside in so far as the petitioner is concerned and pass......" 2.

Heard the learned counsel for petitioner, and the learned Government Pleader for Home (A.P.) on behalf of the respondents 1 & 2 and perused the prayer in the writ petition with supporting affidavit.

The supporting affidavit also in sum and substance saying the same despite the order of this Court in W.P.No.38267 of 2016 dated 08.11.2016 directing respondent No.2 therein to complete the investigation as expeditiously as possible in Crime No.21 of 2016 on the file of Women Police Station, Tirupati, registered for the offences punishable under Section 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act and file a final report without arresting the petitioner, there is Lookout Circular kept pending without closure illegally and contrary to the direction in the said writ petition.

The counter affidavit of respondent No.2-Station House Officer, Mahila Police Station, Tirupati Urban District is that there is nothing in the writ petition order to cancel the Lookout notice. Leave about the fact that in Crime No.21 of 2016 pursuant to the direction of this Court in W.P.No.38267 of 2016 the investigation was completed and charge sheet was filed on 27.02.2017 before the learned IV Additional Judicial First Class Magistrate, Tirupati and so far as the Lookout Circular is concerned, the Superintendent of Police, Tirupati Urban District, Tirupati, initiated action for withdrawal of the Lookout Circular issued earlier against the petitioner by personal letter dated 18.02.2017 to the Additional Director General of Police, C.I.D, A.P. for deletion of the name of petitioner from said Lookout Circular.

Having regard to the above, by recording the same this Writ Petition is disposed of directing the respondents to delete the name of petitioner from the Lookout Circular and report compliance by intimation to the petitioner within two months from today.

No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
