HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26792 OF 2014 ORDER:
This Writ Petition is filed with the following relief - "...... to declare the action of the 3rd respondent in not allowing me to continue as dealer of F.P. Shop No.35, Isukapally, U.
Kothapally Mandal, E.G.District, Andhra Pradesh duly implementing the proceedings in Ref.D/1096/2014, dt.01.08.2014 issued by the 2nd respondent as illegal, arbitrary and contrary to law and pass such other order, or orders, as the Hon'ble Court may deem fit and proper in the circumstances of the case."
This Court on 11.09.2014 made an order in W.P.M.P.No.33490 of 2014 as follows:
"The case of the petitioner is that her fair price shop authorization was restored by the 2nd respondent vide proceedings dated 01.08.2014 and in pursuance of the same, the 3rd respondent also issued proceedings dated 04.08.2014 for restoration of her authorisation. But in spite of the same, the respondents are not supplying stocks to the petitioner for distribution to the card holders.
In view of the proceedings dated 01.08.2014 and 04.08.2014, the respondents are directed to supply the stocks to the petitioner as long as her authorisation is valid and subsisting. However, this will not preclude the competent authority from taking action against the petitioner, in case, the petitioner commits any violation." A perusal of the affidavit itself goes to reveal that the grievance of the petitioner is, as long as the petitioner's authorisation is in subsistence, she shall be allowed to discharge her functions as a Fair Price Shop Dealer. This
Court, while making interim order dated 11.09.2014, gave liberty to the respondents to initiate proceedings if warranted and if there are any violations by the petitioner. Nothing has been brought before this Court that any action having been taken by the respondent authorities. Though the learned Government Pleader seeks time for getting instructions, this Court is not inclined to adjourn the matter as the relief granted by way of interim order had taken care and gave liberty to the respondent authorities to take appropriate action. If any orders have been passed by the respondent authorities after passing the interim order dated 11.09.2014 by this Court, disposal of this Writ Petition shall not affect the same and the petitioner shall also be at liberty to seek appropriate remedies in accordance with law with respect to those orders, if any.
With the above observation, this Writ Petition is closed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall also stand closed.
