This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.2, in laying road from Nehru Nagar to the place nearer to the house of one Ch.Malleswara Rao of Kasibugga, Srikakulam District, as per Resolution, dated 29.11.2014, as illegal and arbitrary. The petitioner sought for a consequential direction to respondent
No.2 to commence the work of laying the road as per the said resolution without any further delay. Mr.Nimmagadda Venkateswarlu, learned Standing Counsel for Municipalities (AP), submitted that a counter-affidavit was filed vide USR.No.29708 of 2015. However, the office report shows that the counter-affidavit was returned on 07-12-2015 and the same has not yet been represented.
Be that as it may, the learned Standing Counsel submitted that the subject work was approved vide resolution, dated 02.11.2015, of respondent No.2 and that the same was entrusted on 06-11-2015 to a Contractor for execution by fixing the period of 90 days for completion.
The learned Counsel for the petitioner submitted that in view of the above noted submission of the learned Standing Counsel, no further adjudication of the Writ Petition is necessary. Having regard to the above facts, the Writ Petition is disposed of by placing on record the above noted submission of the learned Standing Counsel.
As a sequel to disposal of the Writ Petition, WPMP.No.44918 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 9th December, 2015 LUR
