THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2758 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

The allegation is that A.1 used to supply bricks to the forest department as contractor and he developed acquaintance with the husband of the de facto complainant and out of such acquaintance, A.1 represented that if bricks are self manufactured, profits will be high and so saying, A.1 asked the husband of the de facto complainant to invest Rs.5,00,000/- in the bricks business so that he would get Rs.0.50 paisa as profit for each brick and believing his words, the husband of the de facto complainant invested Rs.5,00,000/-. A.2, who is the son of A.1, used to look after the business. Later, both of them cheated the husband of the de facto complainant without paying any money. Out of humiliation, the husband of complainant died due to BP. Hence, the complaint against the accused for the offences under Sections 415, 420 and 464 of IPC.

Having regard to the prima facie accusation made out against the accused in the FIR, it is not a fit case to quash the proceedings. Hence, the investigation shall be conducted to its logical end. However, considering the submission of learned counsel for petitioner, the Police of Sirput (T), Adilabad District, are directed not to arrest the petitioners/Accused Nos. 1 and 2 during the course of investigation. The petitioners shall cooperate with the investigating agency for smooth completion of investigation.

With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any, pending shall stand closed. ______________________ U.DURGA PRASAD RAO,J 07-04-2015 eha
