ORDER:

In this writ petition, the petitioner challenges the provisional seniority list of Junior Assistants/Typists of the Telangana State Northern Power Distribution Company Limited, Karimnagar, communicated vide proceedings, dated 13.11.2015. Being a provisional seniority list, the petitioner appears to have filed objections, but so far, the objections are not finalized. Apprehending that the respondents are taking steps to affect promotions to the next higher cadre based on the said provisional seniority list, this writ petition is filed.

2. It appears that the litigation is already pending on the inter se seniority. Be that as it may, what is challenged is only a provisional seniority list. If there is wrong entry made in the provisional seniority list or due placement is not granted to the petitioners and in spite of raising objections by the petitioners, the request was not considered properly, but the seniority list is finalized, it is always open to the petitioners to work out their remedies. If promotions are affected based on the seniority list, provisional or final and if the petitioners succeed in establishing that wrong fixation of seniority was made and the same is rectified, the promotions so made can always be reviewed. It is not a case that the officer who issued the provisional seniority list is not competent. No ground is made out for interference in the provisional

seniority list.

3. Therefore, the Writ Petition is dismissed, leaving it open to the petitioners to work out their remedies as available in law. The dismissal of the writ petition does not take away the claims as available to the petitioners. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
