THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18412 OF 2019 O R D E R:

The grievance of the petitioner is that the 2nd respondent - Tahsildar, Anthargaon Mandal, Peddapally District is not taking action upon her Application dated 10.07.2019, whereby she sought mutation of her name in the revenue records in relation to the land in Survey Nos. 23/2, 24, 53, 54, 55, 56, 57 and 59 of Mogalpahad Village Shiwar of Anthargaon Mandal on account of death of her husband.

Perusal of the record reflects that the petitioner merely submitted an Application in this regard without following the procedure prescribed under the Telangana Rights in land and Pattadar Passbooks Act, 1971. The said enactment requires submission of an Application in Form VI(A) along with requisite fee for this purpose. Without submitting an Application as per the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities. The Writ Petition is accordingly, disposed of leaving it open to the petitioner to submit an Application in the prescribed format along with requisite fee, if she so chooses. In the event such an Application is made, the Tahsildar, Anthargaon Mandal shall take necessary action thereon in accordance with the due procedure expeditiously, in any event not later than three from the date of its receipt. No costs.
