THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TRANSFER CC.M.P.NO.6 OF 2016 O R D E R:

This Transfer C.M.P. is filed by the petitioner-wife against the respondent husband for transfer of H.M.O.P.No.171 of 2015 pending on the file of Senior Civil Judge, Machilipatnam, Krishna District to the file of Senior Civil Judge, Eluru, West Godavari District.

Though notice is served, there is no representation on behalf of the respondent. The averments made in support of the Transfer C.M.P. go to show that the petitioner is having two minor children and they are staying with her parents at Denduluru village, West Godavari District and she is unable to travel all the way from Denduluru to Machilipatnam for defending her case. Since these facts are un-controverted by the respondent, O.P.No.117 of 2015 instituted by the respondent is liable to be transferred to the file of Senior Civil Judge, Eluru, West Godavari District.
