THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.16113 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner complaining the inaction on the part of the 4th respondent in registering a criminal case on the complaint of the petitioner, dated 02.04.2018, lodged against the Manager of the 5th respondent Theatres.

I have heard the submissions of Sri Y.V.Srinivasan, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.), appearing for the respondents 1 to 4. I have perused the material record. 3.

At the hearing, learned counsel for the petitioner submits that if a direction is given to the Police Officer concerned to take suitable action by following the precedential guidelines in Lalita Kumari v. Government of Uttar Pradesh1, the ends of justice would be met.

Learned Government Pleader for Home submits that the representation of the petitioner discloses that the matter is purely civil in nature and that a civil suit in O.S.No.231 of 2018 is pending on the file of Senior Civil Court, at Vijayawada, and, therefore, the petitioner is advised to seek redressal of his grievance in the civil proceeding.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Satyanarayanapuram Police Station, Vijayawada, Krishna District, to take suitable action, in accordance with the guidelines in Lalita Kumari Vs. Government of Uttar Pradesh2, as expeditiously as possible. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
