THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.26121 of 2015 ORDER :

Heard learned counsel for petitioner and Sri P. Keshava Rao, learned Standing counsel for the Respondents 2 and 3 and with their consent, the writ petition is taken up for disposal at the admission stage.

2. This writ petition is filed questioning the action of the respondent authorities in not taking action on the representation of the petitioner dated 09.05.2014 regarding illegal constructions made by the 4th respondent and in not demolishing the illegal structures made in premises bearing H.No.4-11/30, situated at St.No.3, Boggulkunta, Ramkote, Hyderabad, as illegal.

3. The petitioner owns a residential house bearing H.No.4-1-1-31/1, St.No.3, Boggulkunta, Hyderabad and has left some open space around her house. The 4th respondent has demolished his old house in premises bearing H.No.4-1-1-30, and proceeding with new construction projecting his structures into the open space of the petitioner's property. The 4th respondent is making unauthorized and illegal constructions without obtaining any permission and without leaving set backs. The petitioner submitted a representation on 09.05.2014 to the 3rd respondent about the illegal constructions raised by the 4th respondent. But the authorities have not taken any steps on the representation of the petitioner and on the other hand, the 4th respondent is proceeding with construction of Ground + 3 upper floors. Hence, this writ petition.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the representation dated 09.05.2014 submitted by the petitioner.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondent authorities to consider the representation of the petitioner dated 09.05.2014 and pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. The respondent authorities are directed to put the

4th respondent on notice, before passing the orders on the representation of the petitioner. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
