THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.12573 OF 2016 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The relief sought for in this writ petition is to declare the action of the respondents in not passing final order pursuant to the show cause notice dated 10.02.2016.

S ri S.Suri Babu, learned Special Standing Counsel for Commercial taxes, on instructions, would submit that an assessment order was passed, after the writ petition was filed, on 21.04.2016 and a copy of the said assessment order would be made available to Sri R.Siva Sai Swaroop, learned counsel for the petitioner, during the course of the day.

As the cause in the writ petition does not survive, consequent on the assessment order being passed on 21.04.2016, the writ petition has become infructuous. It is made clear that this order shall not preclude the petitioner from questioning the assessment order in appropriate legal proceedings.

The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
