THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18491 of 2019 ORDER:
The petitioner asserts that she and her two brothers, who are residing in USA, have inherited land to an extent of Acs.12.38 guntas in Survey Nos.726 part, 729 part, 736/A, 737/E part and 738/E part situated at Tallampadu Village, Khammam Rural Mandal, Khammam District, and that to ascertain the correct extent of land, which was in their possession, as on date, she sought survey of the land by filing necessary application but the same was not being undertaken by the authorities. However, pursuant to the order of this Court in writ petition No.15320 of 2018 dated 27.04.2018, a survey was conducted by the Mandal Surveyor and a report was submitted by him. Enclosing the report of the Mandal Surveyor evidencing that the land to an extent of Acs.11.03 guntas is in their possession and enjoyment, she submitted an application for mutation of their names in the revenue records. However, the same is not being carried out by the fourth respondent - Tahsildar, Khammam Mandal. Hence, she filed the present writ petition.
Learned Government Pleader for Revenue appearing for the respondents would point out that as per the procedure, the
CKR, J W.P.No.18491 of 2019 petitioner has to file an application in Form-VIA specifying the details as needed and that as and when such application is filed, the same would be considered in accordance with law. It is to be noted that the petitioner had not filed any such application as on date, as such, she had no grievance. In the light of the aforesaid fact situation of the case, the writ petition is disposed of by giving liberty to the petitioner to file an application as prescribed, and thereupon, the same shall be disposed of within four (4) months from the date of receipt thereof.
Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
