HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 33402 of 2017 ORDER:
The case of the petitioner is that he was issued showcause notice dated 22-08-2017 stating that why disciplinary action should not initiated against him and whey he should not be removed from the rolls of Home Guards. The petitioner filed WP.No.29993 of 2017 challenging the said show-cause notice and this Court granted interim order dated 05-09-2017. This Court disposed of the said writ petition on 12-09-2017 granting liberty to the petitioner to file explanation within a period of four weeks.
Learned counsel for the petitioner says even before his explanation is filed, 2nd show-cause notice is issued on 13-09-2017 stating that explanation of the petitioner is not satisfactory and to show cause him why he should not be removed from the rolls of Home Guards. Learned counsel submits that even before the petitioner has not submitted any explanation, the authority came to the conclusion that his explanation is not satisfactory. Heard learned Government Pleader for Services. It is to be seen that as on today, no orders are passed. Even 2nd show-cause notice is issued based on same facts without filing explanation by the petitioner,
though he was given chance of filing explanation within seven days.
Learned counsel for the petitioner says that the petitioner will file explanation within one week from today.
In view of the same, this writ petition is disposed of granting liberty to the petitioner to file explanation within one week from today and on filing of such explanation, the respondents are directed to consider the same and pass final orders.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
