ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:- " ... to declare the action of the Respondent No 3 in interfering with the personal life and liberty and construction activities Petitioner property property bearing H.No.8-3-192/2/1, situated at Bharath Nagar, Yengal Rao Nagar Cooperative Housing Society, Hyderabad, on the influence of the unfficial Respondent No.4 to settle the civil disputes civil suit in O.S No.l903/2024 is pending before the V Junior Civil Judge City Civil Court, Hyderabad which is illegal and contrary to lqw and infringement of Fundamental Right of the Petitioner as guaranteed under Article i,9, 2l and 3004 of the Constitution of India..."

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home, for the respondent Nos.1 to 3. Perused the record.

The grievance of the petitioner is that, the respondent police authorities at the behest of respondent No.4 are interfering with the petitioners peaceful possession over the property bearing Municipal No.8-3-L92/2/1, situated at Bharath Nagar, Vengal Rao Nagar Co-operative Housing Societ5r, Hyderabad and are trying to settle the civil dispute between the petitioners and respondent No.4.

On the other hand, learned Assistant Government Pleader for Home on instructions would submit that a complaint has been received from respondent No.4 against the petitioners and on such complaint Crime No.49 of 2024 was registered and subsequently a charge sheet was filed which was taken cognizance urde C.C.No.4643 of 2O2S and. same is pending for trial. It is further submitted that except conducting enquiry, the respondent authorities neither interfered in the civil disputes nor with the petitioners peaceful possession over the subject property.

5. In that view of the matter, the respondent_police authorities are directed not to interfere in the civil disputes between the parties without following the due procedure as contemplated under law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
