HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 25361 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in rejecting the case of the petitioner for the post of Conductor under bread winner scheme vide proceedings dated 22.11.2002, as illegal and arbitrary. It has been contended by the petitioner that his father died on 24.12.1999 while working as Driver in the respondent corporation. Subsequently, he submitted an application to the respondent corporation seeking compassionate appointment under bread winner scheme, but the respondent corporation had not considered his case and rejected his case vide orders dated 22.11.2002 advising him to opt for additional monetary benefit in lieu of employment. Later on, he submitted another representation dated 23.11.2002 seeking to provide any suitable post under bread winner scheme and the same is still pending consideration.

This Court having considered the said submission is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation of the petitioner. Accordingly, the writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 23.11.2002 and pass appropriate orders thereon in four weeks from

the date of receipt of a copy of this order. It is needless to say that the petitioner is also permitted to submit a fresh representation.
