THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13028 OF 2016 ORDER:

This petition is filed by the petitioner-A2 under Section 482 Cr.P.C. seeking to quash the proceedings against her in C.C.No.119 of 2016 on the file of the XIV Metropolitan Magistrate, Cyberabad, Ranga Reddy District. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 498-A IPC and 494 IPC.

Learned Counsel for the petitioner submitted that the petitioner is the legally wedded wife of A1 and that as A1 started harassing the petitioner, she filed a private complaint and the same was registered as Crime No.193 of 2015 and that the 2nd respondent has not filed any document that she is the legally wedded wife of the A1.

Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations can be decided after full fledged trial. Therefore, this Court is not inclined to grant the relief sought by the petitioner.

At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when her presence is specifically required by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates. Accordingly, the Criminal Petition is disposed of.
