(Per Ilon'ble Sri Justice Abhinand Kumar Shavili) When the matter is taken up for hearing, learned counsel appearing for the cross objector/claimant submitted that the issue raised in the present appeal and the cross obiections is squarely covered by the comnron.judgment, dated 24.02.2005, rendered by this L Corrrt in A.S.No.190t3 of 2001 and batch, wherein, this Court has held ( that the claimants are entitled to compensation at the rate of Rs.80/- per Square Yard with 1/3.d deduction, which works out to Rs.53/- per Square Yard and following the same, the present appeal and the cross objections are also liable to be disposed of fixing the compensation for the subject land at Rs.53/- per Square Yard 2.

Learned Government Pleader for appeals appearing for the appellant did not dispute the said fact 3.

In view of the said submissions, this Court is of the considered view that the present appeal and the cross objections (SR) are liable L

to be disposed of following the common judgment, dated 24.02.2O05, rendered by this Court in A.S.No.1908 of 2001 and batch. 4.

Accordingly, the appeal and the cross objections (SR) are disposed of following the common judgment dated 24.02.2005, rendered by this Court in A.S.No.1908 of 2001and batch. There shall be no order as to costs.

Miscellaneous Applications, if any, pending in this appeal shall stand closed.
