This Criminal Petition is filed by the petitioner/A.2 against the order of the trial Court in Crl.M.P.No.826 of 2026 in S.C.No.51 of 2020 on the file of the learned IV Additional Sessions Judge, at Hyderabad.

The brief facts of the case are that the petitioner herein has filed the bail petition before the trial Court and the same was dismissed by the trial Court stating that the petitioner herein had not attended before the trial Court, as such, NBW was issued to the petitioner on 29.12.2021 and thereafter, also the petitioner herein has not filed any application before the trial Court for recall of the same and the same was executed by the police and the petitioner was remanded to the judicial custody on 15.04.2026.

Heard Sri Ravi Ankuri, learned counsel for petitioner, and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent -State. 4.
Learned counsel for the petitioner submitted that the petitioner had been regularly attending the proceedings before the trial Court until the year 2019. It was contended that, acting upon the advice of his counsel, the petitioner could not attend the Court proceedings during the COVID-19 pandemic period, i.e., from 2020 to 2021. Learned counsel further submitted that the petitioner was remanded to judicial custody on 15.04.2026 pursuant to the execution of a NonBailable Warrant (NBW). He further submitted that the
petitioner is a permanent resident of the local area and is willing to cooperate with the trial Court and he assured the Court that the petitioner would regularly appear before the trial Court and abide by any conditions that may be imposed by this Court and prayed to grant bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that despite the issuance of a NonBailable Warrant (NBW), the petitioner failed to appear before the trial Court and because of the petitioner, the trial is pending, as such he is not entitled for bail. Therefore, petitioner is not entitled for bail and prayed to dismiss the criminal petition.

Considering the submissions made by both the counsel and material on record, it is evident that the petitioner has been in judicial custody since 15.04.2026. It is also the specific case of the petitioner that he had been regularly attending the proceedings before the trial Court until the year 2019 and that his subsequent non-appearance was on account of the advice given by his counsel.. Hence, considering the period of incarceration of petitioner and the
allegations against the petitioner herein, this Court deems it appropriate to grant bail to the petitioner-A.2 subject to the following conditions.
i. The petitioner-A.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the IV Additional Sessions Judge, at Hyderabad ii. The petitioner-A.2 shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner-A.2 shall abide by the conditions stipulated in Section 483(2) of the BNSS.
iv.
The petitioner-A.2 shall attend before the trial Court on every adjournment.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
