THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 4794 of 2022 ORDER:
This Criminal Petition is filed under Section 438 Cr.P.C. by petitioner/A2 seeking bail in the event of her arrest in connection with Crime No.103/2022 on the file of Ghatkeshwar Police Station, Rachakonda, registered for the offences punishable under Sections 409 and 420 of Indian Penal Code.

The case of the prosecution is that Accused No.1 is Assistant Manager in Axis Bank, Pocharam branch and worked in the said branch from 10.06.2014 till 28.11.2021. In the course of his bank business as Assistant Manager, he has committed several illegalities and transferred an amount of Rs. 48,71,739.68 ps. to the account of this petitioner and thereafter the same amounts were withdrawn. 3.
Learned Counsel for the petitioner submits that this petitioner is a house wife and illiterate and nothing to do with the alleged transactions in question and further she does not know about the illegalities committed by Accused No.1.

As seen from the Remand Report of A1, it was Accused No.1 who transferred the said amounts into the account of Accused No.2 and in the said scenario custodial interrogation of this petitioner/A2 who is a lady aged 62 years, is not warranted.

In the said circumstances, the relief of Anticipatory bail can be granted to this petitioner /A2 on the following conditions.
1) The petitioner/A2 is directed to surrender before the Station House Officer, Ghatkeshwar Police Station, Rachakonda, within a period of 10 days from the date of receipt of copy of this order. On such surrender, the said Station House Officer shall release the petitioner/ A2 on bail, on her executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioner/ A2 shall appear before the said Station House Officer as and when required for the purpose of investigation.
3) The 2nd petitioner/ A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.
Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
