HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18960 of 2016 ORDER:
This writ petition is filed seeking issuance of Mandamus declaring that the investigation carried out by the 5th respondent in respect of Crime No.98 of 2016 of Tiruvuru Police Station, Krishna District, is not in accordance with the procedure established by law and is opposed to Rule of Law and consequently sought a direction to respondent No.1 to entrust the investigation in the above crime to an independent investigating agency or by any other superior officer of respondent No.5. Heard learned counsel for the petitioner and the learned Government Pleader for Home.
Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that a direction may be given to the respondents to consider the representations dated 02.06.2016 and 05.06.2016 made by the petitioner seeking investigation in Crime No.98 of 2016 of Tiruvuru Police Station, Krishna District, by an independent investigation agency.
In view of the above facts and circumstances and without going into the merits of the case, this writ petition is
disposed of directing the third respondent to consider the representations dated 02.06.2016 and 05.06.2016 made by the petitioner seeking investigation in Crime No.98 of 2016 of Tiruvuru Police Station, Krishna District, by an independent investigation agency, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
