HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.13955 of 2011 ORDER:

The relief sought for in this Writ Petition is for a mandamus to declare the action of the Joint Collector, Machilipatnam in not passing any orders on the revision petition filed by the petitioner, for release of the petitioners' lorries seized by the Assistant Supply Officer, Vijayawada and in handing it over to the Station House Officer, Patamata, Vijayawada, as arbitrary and illegal. A consequential direction is sought to the respondents to release the lorries to the petitioners forthwith pending disposal of the Writ Petition. By order dated 11.05.2011, this Court directed the Joint Collector, before whom the application for release of the lorries was pending, to dispose the application within a period of two weeks.

As the Joint Collector was directed to dispose the application, filed by the petitioner, within a period of two weeks, any grievance which the petitioner may have against the order passed by the Joint Colector thereafter can only be agitated in independent legal proceedings. It is evident, therefore, that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs.
